This data set describes the locations of many of the California Department of Fish and Wildlife Incidental Take Permits and Consistency Determinations (also known as "CESA" permits) applied for and approved between 1998 and November 2024. In order to fully use this data set, you much link it to the associated "CESA Permit Species" table.
The California Endangered Species Act (CESA) states that all native species of fishes, amphibians, reptiles, birds, mammals, invertebrates, and plants, and their habitats, threatened with extinction and those experiencing a significant decline which, if not halted, would lead to a threatened or endangered designation, will be protected or preserved. The California Department of Fish and Wildlife (CDFW) will work with all interested persons, agencies and organizations to protect and preserve such sensitive resources and their habitats. CESA prohibits the take of any species of wildlife designated by the California Fish and Game Commission as endangered, threatened, or candidate species. CDFW may authorize the take of any such species if certain conditions are met. "Incidental Take Permits"" (ITPs) or "Consistency Determinations" (CDs) allow a permittee to take (hunt, pursue, catch, capture, or kill, or attempt to hunt, pursue, catch, capture, or kill) a CESA-listed species if such taking is incidental to, and not the purpose of, carrying out an otherwise lawful activity. ITPs are completed entirely within CDFW, while CDs are approval based on Federal Biological Opinions. These permits are most commonly issued for construction, energy, residential or commercial development, transportation, and other infrastructure-related projects. Permittees must implement species-specific minimization and avoidance measures, and fully mitigate the impacts of the project. Each permit names one or more species for which take is permitted under the permit. This species data is in the associated "CESA Permit Species" table.
This feature class represents the buffered locations of ITP or CD impact sites. The permit impact locations were initially digitized as either point, line, polygon, or multipoint features and then buffered to create polygons and merged together. Their shapes are either exact, close, or approximate. Sites which are exact or close are buffered from digitized data which accurately represents the site. "Approximate" sites are sites at which only vague location data was available so the mapping was done to the best of the digitizers ability and only approximates the project location. The unbuffered data can be acquired by contacting the CDFW contact or CESA@wildlife.ca.gov. The link field links to the original Incidental Take Permit or Consistency Determination which is located in CDFW's document library. Older ITPs and CDs may not be accessible to the public through this link but can be obtained by contacting CESA@wildlife.ca.gov. This dataset is designed to be used in conjunction with the "CESA Covered Species" table, which shows which species are covered by each Permit and can also be found in the downloadable geodatabase. To use these data sets, link them on the Project Number field.
